One of the most important elements of the maritime transport industry is sea freight. Both the forwarding practice and the legal side of undertakings in the field of TSL are based on many rules as well as professional arrangements. One of the most important, universally applicable standards are the International Commercial Terms. These regulations are particularly important in the industry of transport and forwarding services as well as in the transport of containers. The Incoterms 2020 version is currently in force.
What is Incoterms?
Incoterms is a set of international legal rules commonly accepted in the practice of sea freight. Their task is to define the global interpretation of the terms of sale used in the TSL industry. They are widely used by companies operating both in Gdańsk and within the commercial port in Gdynia.
This collection regulates the division of costs and responsibility for the transport process between the buyer and the seller and determines the method of transport. In our company, we employ only high-class specialists who are up to date with all the news in the field of Incoterms.
The overriding law governed by Incoterms is the United Nations Convention on Contracts for the International Sale of Goods, which was published in 1936 and regulates shipping. Currently, the Incoterms 2020 version is in force, which replaced the previous version from 2010.
The main features of the set of legal regulations in transport:
- obligation to trade in tangible goods,
- their use is optional,
- they apply only to the exporter and importer, while shippers and transport companies are excluded from their application,
- the norms of the law governing a given contract take precedence over Incoterms.
Incoterms regulate matters related to the sea transport of products from the seller to the buyer. This includes, inter alia, transport of products, settlement of export and import liability, coverage of costs (including transport and insurance) and transfer of risk for the condition of products at various points in the transport process. Incoterms are always used in conjunction with a geographic location and do not deal with the transfer of property rights. Widely used in the practice of reloading.
